It is issued when the authorities consider that a foreigner is in an <b>irregular situation on French territory<\/b>: visa expired, asylum application rejected, or residence permit refused. In accordance with  <b>art. L.611-1 et seq. <\/b>The prefect notifies the measure in writing and sets a deadline for leaving France. As long as it is not suspended or cancelled, this decision remains enforceable. Many people discover this mechanism with astonishment, when they receive an official announcement that they have difficulty understanding, given the technical nature of the legal texts.  <\/span><\/p><h3 class=\"MsoNormal\"><b><span lang=\"FR\">Immediate consequences and penalties for non-compliance<\/span><\/b><\/h3><p class=\"MsoNormal\"><span lang=\"FR\">Receiving an OQTF changes everything: in an instant, a career path built in France is threatened. In particular, foreign nationals retain : <\/span><\/p><ul style=\"margin-top: 0cm;\" type=\"disc\"><li class=\"MsoNormal\"><span lang=\"FR\">the <b>right to marry<\/b>, guaranteed by<b> article 12 of the ECHR (European Convention on Human Rights)<\/b> and confirmed on several occasions by the French <b>Constitutional Council<\/b>,<\/span><\/li><li class=\"MsoNormal\"><span lang=\"FR\">the right to lodge an <b>administrative<\/b> or judicial <b>appeal<\/b>,<\/span><\/li><li class=\"MsoNormal\"><span lang=\"FR\">the right to <b>legal counsel<\/b> to challenge the decision.<\/span><\/li><\/ul><p> <\/p><p class=\"MsoNormal\"><span lang=\"FR\">These rights are invaluable, as they enable us to fight deportation and build a future in France. In some cases, <b>marriage or regularization through family life<\/b> can offer a new way out. The <b>conditions<\/b> are the same as for any couple: <\/span><\/p><ul style=\"margin-top: 0cm;\" type=\"disc\"><li class=\"MsoNormal\"><b><span lang=\"FR\">be of legal age,<\/span><\/b><\/li><li class=\"MsoNormal\"><span lang=\"FR\">le <b>consentement<\/b> doit \u00eatre libre, <\/span><\/li><li class=\"MsoNormal\"><span lang=\"FR\">not already be married ( <b>polygamy is forbidden<\/b> in France)<\/span><\/li><li class=\"MsoNormal\"><span lang=\"FR\">provide the required documents (birth certificate, proof of identity, certificate of celibacy, sometimes a consular card).<\/span><\/li><\/ul><p> <\/p><p class=\"MsoNormal\"><span lang=\"FR\">The absence of a <b>residence permit<\/b> is not a legal ground for refusal. The Civil Code does not make the right to marry conditional on legal residency: the absence of a residency permit is therefore not in itself a legal ground for refusal. <\/span><\/p><h3 class=\"MsoNormal\"><b><span lang=\"FR\">The role of the mayor and the public prosecutor<\/span><\/b><\/h3><p class=\"MsoNormal\"><span lang=\"FR\">As a<b>civil registrar<\/b>, the <b>mayor<\/b><b>is obliged to proceed with the marriage ceremony<\/b>. However, if<b>the mayor suspects fraud<\/b> (e.g., a <b>sham marriage<\/b> intended solely to obtain a residence permit), he may refer the matter to the <b>public prosecutor for<\/b> preliminary investigation or opposition, but the municipal authority must apply the law, and in the event of serious doubt, <b>the public prosecutor makes the final decision.<\/b> <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">The mayor may refer the matter to the public prosecutor if fraud is suspected. The public prosecutor can then order <b>a one-month stay of execution<\/b>, renewable once, to allow time to verify the validity and sincerity of the proposed marriage, or <b>oppose it<\/b> if the legal conditions are not met. <\/span><\/p><p class=\"MsoNormal\"><b><span lang=\"FR\">But the mere existence of an OQTF does not justify a refusal.<\/span><\/b><\/p><p class=\"MsoNormal\"><span lang=\"FR\">As recent cases in the media have reminded us, refusal on the sole grounds of irregularity exposes the mayor&#8217;s office to judicial censure.<\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">For example, in B\u00e9ziers, Robert M\u00e9nard refused to celebrate the union of a Franco-Algerian couple on the grounds that the future spouse was subject to an OQTF. Despite instructions from the public prosecutor to celebrate the marriage, the mayor refused to do so, refused to appear in court and the case was referred to<b>the criminal court.<\/b> This case has rekindled a political debate on the possibility of refusing certain marriages when one of the future spouses is in an irregular situation. A bill to prohibit marriage in France when one of the future spouses is illegally resident was passed by the Senate in February 2025, but the text has not yet been definitively adopted by Parliament.   <\/span><\/p><h3 class=\"MsoNormal\"><b><span lang=\"FR\">PACS and cohabitation as alternatives<\/span><\/b><\/h3><p class=\"MsoNormal\"><span lang=\"FR\">In addition to marriage, there are other less restrictive forms of union:<\/span><\/p><ul style=\"margin-top: 0cm;\" type=\"disc\"><li class=\"MsoNormal\"><span lang=\"FR\">By law, <b>a PACS (civil solidarity pact)<\/b> can be entered into with a foreign national even without a residence permit, as the law does not make its conclusion conditional on legal residency. It can be used to prove the stability of the relationship, but <b>does not confer the same residency rights as marriage.<\/b> <\/span><\/li><li class=\"MsoNormal\"><span lang=\"FR\"><b>Cohabitation<\/b> (living together as evidenced by a joint lease, bills, bank accounts) can be used to prove the length of a relationship when applying for a new residence permit.<\/span><\/li><\/ul><p> <\/p><p class=\"MsoNormal\"><span lang=\"FR\">These alternatives<b> do not prevent a deportation procedure<\/b>, but they do provide useful evidence for a regularization application.<\/span><\/p><h2 class=\"MsoNormal\"><b><span lang=\"FR\">What are the consequences of marrying under an OQTF?<\/span><\/b><\/h2><h3 class=\"MsoNormal\"><b><span lang=\"FR\">Marriage does not cancel the OQTF<\/span><\/b><\/h3><p class=\"MsoNormal\"><span lang=\"FR\">The decision remains valid until suspended or overturned by a judge. The central question remains: <span style=\"text-decoration: underline;\"><a href=\"https:\/\/gpartners-avocat-etrangers.com\/en\/oqtf-what-to-do-the-essential-steps-for-a-rapid-appeal\/\" target=\"_blank\" rel=\"noopener\"><b>I&#8217;ve received an OQTF, what should I do?<\/b><\/a><\/span> However, a marriage can serve as a<b>new element in an application for a<\/b> residence permit. <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">In concrete terms: you can get married, but if you don&#8217;t start proceedings within the deadline, the authorities may still expel you from France. To limit this risk, it&#8217;s essential to <b>prepare both the marriage and the contestation in parallel<\/b>: respect the deadlines, check whether the procedure has a suspensive effect, and gather all evidence of cohabitation. The aim is to avoid the union being celebrated under the immediate threat of deportation.  <\/span><\/p><h3 class=\"MsoNormal\"><b><span lang=\"FR\">Towards regularization as the spouse of a French national<\/span><\/b><\/h3><p class=\"MsoNormal\"><span lang=\"FR\">Marriage can open the door to a residence permit application. Article L.423-1 of the CESEDA stipulates that foreign nationals married to French nationals can apply for a &#8220;<span style=\"text-decoration: underline;\"><a href=\"https:\/\/gpartners-avocat-etrangers.com\/titre-de-sejour-vie-privee-et-familiale\/\"><strong>private and family life<\/strong><\/a><\/span>&#8221; <b>residence permit<\/b>, provided they are actually living as a couple. <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">This means that the prefectoral authority is not content with the marriage certificate <b>issued at the town hall<\/b>: it verifies the <b>sincerity of the union<\/b>. The<b>authorities<\/b> may ask for <b>documents<\/b> such as a joint lease, invoices or proof of shared income. The aim is to ensure that the <b>marriage is not a sham marriage<\/b>, prohibited by law and punishable by<b>up to 5 years&#8217; imprisonment and a \u20ac15,000 fine<\/b>.  <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">This procedure is a lengthy <b>administrative process<\/b>, often taking several months to be examined by <b>public authorities<\/b>. The decision also depends on respect for the <b>freedom of marriage<\/b>, <b>guaranteed by the Constitution<\/b> and confirmed by the French <b>Constitutional Council<\/b> and the <b>European Convention on Human Rights<\/b>. <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">Even if regularization is never automatic, it remains a <b>legitimate hope<\/b> for many<b> mixed<\/b> couples. The questions are about meeting people, everyday life, family and habits. They examine the layout of the home, the presence of personal belongings or shared rooms (photos, clothes, everyday objects). <\/span><\/li><li class=\"MsoNormal\"><b><span lang=\"FR\">Investigations into cohabitation<\/span><\/b><span lang=\"FR\"> Evidence of cohabitation: the<b>registrar<\/b> or<b>authorities<\/b> may request evidence of cohabitation, such as joint bank statements, invoices, testimonials from relatives, children&#8217;s school enrolments, etc.<\/span><\/li><\/ul><p> <\/p><p class=\"MsoNormal\"><span lang=\"FR\">If the authorities deem this to be a <b>sham marriage<\/b> (intended solely to obtain a right of residence), the consequences are serious. <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006335298\" target=\"_blank\" rel=\"noopener\"><b>Article L.623-1 of the CESEDA<\/b><\/a><\/span> provides for criminal prosecution<b>(up to 5 years&#8217; imprisonment and a fine of 15,000 euros<\/b>). The marriage may also be annulled by the judge, and the application for a residence permit refused. <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">There is also the notion of <b>&#8220;grey marriage<\/b>&#8220;, where one of the spouses deceives the other about his or her intentions (e.g. a French national manipulated by a foreigner seeking only a residence permit). This type of fraud is also punishable by law. <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">For a sincere couple, it is therefore crucial to prepare the dossier carefully and to be able to demonstrate the reality of the relationship. The judge verifies the legality of the prefectoral decision: respect for the <b>right to marry<\/b>, protection of family life (Article 8 ECHR), proportionality of the measure, errors of law or fact. <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">Marriage does not automatically interrupt enforcement of the obligation to leave the country, but it can be presented as a <b>new element<\/b>. Le tribunal peut alors d\u00e9cider de suspendre ou d\u2019annuler l\u2019\u00e9loignement.  <\/span><\/p><h3 class=\"MsoNormal\"><b><span lang=\"FR\">Application for a residence permit as the spouse of a French national<\/span><\/b><\/h3><p class=\"MsoNormal\"><span lang=\"FR\">Once married,<b>foreign nationals<\/b> can apply for a <b>&#8220;private and family life&#8221; residence permit.<\/b> The application must be complete, and include the marriage certificate, the French spouse&#8217;s identity papers, and proof of cohabitation (lease, bills, bank statements, certificates). <\/span><\/p><p class=\"MsoNormal\"><span lang=\"FR\">The prefect&#8217;s office assesses the application with regard to the <b>right to respect for private and family life<\/b> guaranteed by Article<b> 8 of the ECHR and the CESEDA<\/b>. It can summon the couple, request additional documents or carry out checks. If the application is refused, <b>an administrative or judicial appeal remains possible<\/b> to contest the decision and defend the reality of the union.  <\/span><\/p><h2 class=\"MsoNormal\"><b><span lang=\"FR\">What laws govern marriages between foreigners?<\/span><\/b><\/h2><p class=\"MsoNormal\"><span lang=\"FR\">In France, the <b>marriage of foreigners<\/b> is protected by a number of laws guaranteeing <b>freedom of marriage<\/b>.<\/span><\/p><ul style=\"margin-top: 0cm;\" type=\"disc\"><li class=\"MsoNormal\"><span lang=\"FR\">The <b>Civil Code<\/b> lays down rules common to all: majority, free consent and absence of bigamy.
