The <strong>shared life must be genuine and sincere<\/strong> since the marriage, and the spouse must have kept their French nationality. If the <strong>marriage was celebrated abroad<\/strong>, the certificate must be transcribed into the <strong>consular civil status registers<\/strong> before any visa application.<\/p><p>Entry into the territory is, in principle, made <strong>with a long-stay visa<\/strong> equivalent to a residence permit (VLS-TS), to be validated online within 3 months of arrival. A visa waiver is, however, possible for spouses who entered lawfully, married in France and can prove genuine cohabitation on the territory.<\/p><p>For those in a <strong>civil partnership (PACS)<\/strong> with a French national, you must <strong>prove the reality of the relationship and a shared life in France.<\/strong><\/p><p style=\"border-left: 5px solid #085e52; padding-left: 15px; margin-left: 19px; line-height: 1.5;\"><strong style=\"color: #085e52;\">WARNING: <\/strong>marriages of convenience are severely punished: up to 5 years&#8217; imprisonment and a \u20ac15,000 fine.<\/p><h3><strong>Enhanced protection in the event of domestic violence<\/strong><\/h3><p>The breakdown of the shared life cannot be held against you when it results from domestic or family violence. The residence permit is issued or renewed as of right, except in the event of a threat to public order. If your spouse holds <strong>EU long-term resident status<\/strong>, you must <strong>prove prior shared residence in another Member State<\/strong>, <strong>health insurance<\/strong> and <strong>stable and sufficient resources<\/strong>.<\/p><h3><strong>Parent of a French child<\/strong><\/h3><p>If you are the <strong>parent of a French minor child residing in France<\/strong>, you can claim this permit <strong>provided you reside on the territory<\/strong> and can prove an <strong>effective contribution to the child&#8217;s maintenance and education<\/strong> since their birth or for at least two years depending on the situation.<\/p><p>Since the <strong>law of 10 September 2018<\/strong>, the conditions have tightened: where filiation is established by acknowledgement of paternity outside marriage, the foreign mother must prove the effective contribution of the French father to the child&#8217;s upbringing, or produce a court decision to that effect.<\/p><p style=\"border-left: 5px solid #085e52; padding-left: 15px; margin-left: 19px; line-height: 1.5;\"><strong style=\"color: #085e52;\">GOOD TO KNOW: <\/strong>The fraudulent acknowledgement of a child is punished in the same way as a marriage of convenience.<\/p><h3><strong>Strong personal and family ties in France (article L423-23 of the CESEDA)<\/strong><\/h3><p>This article allows those who have lived in France for a long time to <strong>assert the intensity of their personal ties<\/strong>, <strong>even without a direct link to a French national<\/strong>, provided they can prove lasting integration. The prefecture assesses several criteria:<\/p><ul><li>the length and stability of presence in France,<\/li><li>living conditions,<\/li><li>command of French,<\/li><li>the willingness to integrate into local life,<\/li><li>but also the nature of the ties maintained with the family left in the home country (the presence of a spouse or minor children abroad possibly constituting an obstacle).<\/li><\/ul><h3><strong>The sick foreign national or holder of a work-accident annuity<\/strong><\/h3><p>A <strong>foreign national whose state of health requires medical care<\/strong> the lack of which could lead to consequences of exceptional seriousness can apply for this permit, provided they habitually reside in France and <strong>cannot effectively access suitable treatment in their country of origin<\/strong>.<\/p><p>Likewise, a <strong>foreign national receiving an annuity for a work accident<\/strong> or <strong>occupational illness<\/strong> paid by a French body can claim it, provided they can prove a <strong>permanent incapacity rate of at least 20%.<\/strong><\/p><h3><strong>Young people born in France or who entered the territory as minors<\/strong><\/h3><p>Several situations give young people entitlement to this permit:<\/p><ul><li><strong>People born in France who have resided at least 8 years on the territory<\/strong> and were educated in a French institution for at least 5 years from the age of 10, the application having to be filed between the ages of 16 and 21<\/li><li><strong>Young adults who entered France<\/strong> as part of family reunification<\/li><li><strong>Minors who entered outside family reunification<\/strong>, residing in France <strong>since the age of 13<\/strong> with at least one parent with legal status<\/li><li><strong>Young people placed in the care of Child Welfare Services (ASE)<\/strong> before the age of 16, the application having to be filed within the year following their coming of age, after examination of their career plan, their ties with the country of origin and the opinion of the host institution<\/li><li><strong>Children one of whose parents holds a <\/strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/gpartners-avocat-etrangers.com\/en\/lawyer-for-a-talent-passport-what-most-applicants-dont-know\/\"><strong>talent passport card<\/strong><\/a><\/span>, an EU long-term resident card, or has stateless status or subsidiary protection<\/li><\/ul><p> <\/p><h3><strong>Exceptional admission to residence<\/strong><\/h3><p>For foreign nationals who meet none of the cases above, regularisation remains possible on the basis of <strong>humanitarian or exceptional considerations<\/strong>.<\/p><p>Since the <strong>circular of 23 January 2025 (known as the &#8220;Retailleau circular&#8221;)<\/strong>, the conditions have changed considerably: the <strong>required period of presence has risen from 5 to 7 years<\/strong>, the <strong>criteria linked to private and family life have been removed<\/strong> in favour of shortage occupations, and <strong>command of French<\/strong> as well as <strong>holding French qualifications<\/strong> are now decisive criteria.<\/p><p>Each situation is assessed individually by the prefecture. Some procedures are not yet available on the ANEF portal and must be carried out on the &#8220;D\u00e9marches simplifi\u00e9es&#8221; platform.<\/p><p>Once your account is created and your documents uploaded, you receive a <strong>certificate extending the processing period<\/strong>. The ANEF portal regularly experiences slowdowns, inability to upload PDFs or account lockouts. <strong>The danger?<\/strong> That your permit&#8217;s expiry approaches without you having been able to validate your file.<\/p><h4><strong>What to do in the event of a technical failure?<\/strong><\/h4><ul><li><strong>Document the blockage<\/strong>: take dated screenshots showing the error and the inability to validate.
